General Charter Terms and Conditions
This document contains all of the terms and conditions under which the Company, identified herein as Trailways Travel, Tours, and Charters, agrees to furnish the designated services to you, the Customer. This document, when signed by the Customer, will constitute a legally binding contract, and the contract cannot be amended except by another agreement in writing between the Company and the Customer.
The total contract price stated herein is based upon the specific service requested by the Customer. The Customer is therefore advised to carefully read the entire contract document before signing it. If the Customer finds any errors or omissions, return the contract document unsigned and make a notation of all errors and/or omissions. Please make the notation of all errors and/or omissions on the unsigned contract document or in a separate writing. If the Company agrees that the contract document contains any errors and/or omissions, a new contract will be prepared and furnished to the Customer.
If the Customer wishes to make any changes to the agreed upon itinerary, the Customer must contact the Company more than two weeks prior to the scheduled departure date and notify the Company of any requested changes. If the Company does agree to make any requested changes to the agreed upon itinerary and these requested changes result in either an increase or decrease in the stated contract price, a new contract document will be prepared and sent to the Customer for signature. Due to its many scheduling commitments, the Company cannot guarantee that changes in the agreed itinerary will be made if requested less than two weeks ahead of the scheduled departure time.
The Companys driver will be furnished with a copy of the entire agreed itinerary and will be specifically instructed to strictly follow it. The driver has no authority to agree to make any changes in the trip schedule. Rather, any driver must request the prior approval of a duly authorized officer of the company. Therefore, if, after the Customers trip has commenced, the Customer wants to make any change in the agreed upon itinerary, the Customer must so notify the driver at once and the driver will contact the Company. The Company shall have the absolute discretion and right to either agree, or decline, to make any requested changes. If the Company agrees to make any requested changes, the Company shall have the right to insist that any additional payment be made by the Customer directly to the driver. If the Company agrees to any requested change, and if the Customer does not pay in advance, the Customer will become responsible for the payment of the full amount of any increase in the contact price immediately upon completion of the trip. Any additional charges shall be based upon the Companys prevailing tariff rates.
The Company shall not be liable for the loss of any items of personal property, or baggage, stored in either the overhead racks inside the bus, or the luggage compartments underneath the bus. The Customers attention is specifically directed to the fact that the storage compartments located in the under portions of the bus do not have any locks. Therefore, each member of the group shall be responsible for their own personal property and baggage. Each person shall have the responsibility for removing all of their personal property and baggage from the bus at the end of each day of travel, and upon the completion of the trip.
It is understood and agreed that the performance of the service detailed in this order is subject to tariff regulations and is contingent upon the Companys ability to furnish the equipment and perform the service. Baggage and all other property will be handled only at passengers own risk and only in an amount that can conveniently be carried in the chartered bus. Any damage to the vehicle, caused by the Customer, will be charged by the Company to the Customer.
The Company reserves the right to lease equipment from other companies in order to fulfill this charter agreement.
If a charter trip is cancelled 14 days or more in advance of departure date, the Customer will receive a full refund of payments made to the Company.
If a charter trip is cancelled 13 days or less in advance of departure date, the Company reserves the right to charge the Customer 10% of the total trip amount as agreed upon in the contract document.
This document contains and constitutes the entire contract between the parties. Any change in the stated itinerary and/or contract price will not be binding upon the Company unless it is evidenced by another document in writing executed by a duly authorized officer of the Company.
If an Act of God, public enemies, authority of law, quarantine, perils of navigation, riots, strikes, the hazards, or dangers incident to a state of war, accidents, bad conditions of the road, snow storms, and other conditions beyond its control, make it, in the opinion of the Company, inadvisable to operate Charter Coachers either from the Place of Origin or any point en route, the Company shall not be liable therefore.
This contract shall be deemed to have been made in the State of Iowa, performed at least in part herein, and its enforcement and interpretation shall be subject to its Laws.
Most Burlington Trailways deluxe motorcoaches come equipped with: DVD player, PA system, restroom, reclining seats, armrests, footrests, individual light and air controls, air conditioning, individual 110 volt outlets, Wi-Fi, and satellite television.
DVD player is available on all motorcoaches. Use of the DVD player is available at no extra charge. The Customer may supply their own movies. Only the Companys operator may operate the DVD player.
Some motorcoaches also have a galley area available, but require the presence of a Company host for the duration of the trip. If the Customer is interested in a motorcoach with a galley, additional fees may be added to the Customers total cost of the charter.
Food and Beverage
With the exception of sunflower seeds and peanuts in shell, food and non-alcoholic drinks are allowed on the motorcoach. With prior written approval from the Company and an additional $200.00 refundable damage and cleaning deposit, alcohol may be consumed on the mortorcoach. Alcoholic beverages in non-breakable cans or bottles are the only alcoholic beverages that may be consumed on the motorcoach.
Use of all tobacco products and tobacco substitutes is strictly prohibited while on any Burlington Trailways motorcoach.

The total of this contract document is based on the previously stated fuel surcharge chart beginning at $3.00 per gallon. Thirty days before the Customers chartered trip is scheduled to leave, the fuel surcharge percentage rate will be re-evaluated based on the average cost of Low Sulfur Diesel for the Midwest (http://tonto.lia.doe.gov/oog/info/wohdp/diesel_uLsd.asp). If, at thirty days before the chartered trip is scheduled to depart, the fuel surcharge percentage rate has increased compared to the fuel surcharge percentage rate listed on the original contract document, this increase will be applied to the original contract document price as an amendment to the contract.
Thirty days before the Customers chartered trip is scheduled to leave, and after the Company has made any and all fuel adjustments, the fuel surcharge listed on the contract document for the specified chartered trip will become locked in at the listed percentage rate.
If the Customer wishes to lock in the fuel surcharge percentage rate that is specified in the original charter document issued by the Company, the Customer must pay for the chartered trip, in full, within ten days of booking the trip. If a chartered trip is paid in full within ten days of booking, the Company will re-evaluate the fuel surcharge percentage thirty days before the chartered trip is scheduled to leave. If fuel prices have decreased, and the new fuel price corresponds to a decreased fuel surcharge percentage, the Company will refund the Customer the difference between the original fuel surcharge percentage and the new fuel surcharge percentage.
The Customer agrees to respect our professional motorcoach operators decision regarding road conditions, equipment, and safety. Federal regulations allow motorcoach operators to be on duty 15 hours per day, including a maximum of 10 hours driving. A Burlington Trailways operator must then have 9 complete hours off duty before coming back on duty.
